Received a Notice of Gas Piping System Certification Violation? Here’s What’s Happening and What to Do Next

Recently, the NYC Department of Buildings sent out Notices of Gas Piping System Certification Violation – Failure to File related to the Local Law 152 Cycle 2, Subcycle A inspection period ending 12/31/2024.

We’ve heard from many building owners who were surprised to receive this notice because they did complete their gas piping inspection in 2024 and have proof of filing.

If that’s you, take a breath. In many cases, this is fixable.

Why You May Have Received This Notice Even If You Filed

In several cases, the violation notice was issued even though:

  • The inspection was completed in 2024
  • The GPS2 certification was filed
  • The owner received an automated filing confirmation email from the Department of Buildings
  • The owner has copies of their GPS1 and GPS2 paperwork

This appears to be an administrative or system issue where the filing did not properly register against the building record, triggering an automatic violation notice.

What the Violation Notice Says

The notice typically states that you are in violation of:

NYC Administrative Code §28-318
and
Title 1 of the Rules of the City of New York (1 RCNY §103-10)

For failing to submit a required gas piping system certification for Cycle 2, Subcycle A.

The stated civil penalties are:

  • $1,500 for a 3-family residential building
  • $5,000 for all other buildings

Even If You Filed You May Have Received This Notice

In several cases, the violation notice was issued even though:

  • The inspection was completed in 2024
  • The GPS2 certification was filed
  • The owner received an automated filing confirmation email from the Department of Buildings
  • The owner has copies of their GPS1 and GPS2 paperwork

If You Filed in 2024: What You Should Do Now

If you did complete your inspection and filed in 2024, you can challenge the violation.

Follow the Instructions in the DOB Letter

The Department of Buildings allows you to submit a challenge / waiver request through DOB NOW.

What to Upload (Important)

To challenge the violation, you should upload:

  1. Your GPS2 certification
  2. The automated confirmation email from DOB showing your filing was submitted in 2024

The confirmation email subject line typically reads:
“Your Notification of Periodic Gas Piping Inspections form has been submitted to DOB”

The email would have come from:
From: donotreply@buildings.nyc.gov

You do NOT need to upload the GPS1 as part of this challenge.

If your documentation clearly shows that the GPS2 was filed on time, DOB should be able to review the submission and waive the penalty.

If You Can’t Find Your Filing Confirmation

If you’re having trouble locating your confirmation email or records:

  • Search your inbox for donotreply@buildings.nyc.gov
  • Search for “Gas Piping” or “Periodic Gas Piping Inspections”
  • Check with your plumber or service provider who performed the inspection
